.MY DOMAIN NAME REGISTRANT AGREEMENT

1. INTRODUCTION

This .MY Domain Name Registrant Agreement (“Agreement”) sets out the terms and conditions governing the registration, renewal, transfer, management and use of .MY domain names registered through Zenpipe Nexus Sdn. Bhd. (“Zenpipe”), a registered Registrar appointed by MYNIC Berhad (“MYNIC”) for the provision of .MY domain name registration services.

For the purposes of this Agreement:

  • MYNIC acts as the Registry responsible for the administration and operation of the .MY country-code top-level domain (“ccTLD”); and

  • Zenpipe acts as the Registrar through which Registrants may apply for and manage eligible .MY domain names.

By applying for, registering, renewing, transferring or maintaining a .MY domain name through Zenpipe, the Registrant acknowledges that the Registrant has read, understood and agreed to be bound by:

  1. this Agreement;

  2. the applicable policies, rules, procedures and requirements issued by MYNIC from time to time; and

  3. applicable Malaysian laws and regulatory requirements.

This Agreement supplements the applicable MYNIC policies and requirements and does not replace them.

Where a mandatory MYNIC policy or requirement conflicts with this Agreement, the applicable MYNIC policy or requirement shall prevail to the extent of that conflict.

 

2. DEFINITIONS

In this Agreement, unless the context otherwise requires:

“Domain Name” means a domain name within the .MY namespace registered or applied for through Zenpipe.

“Registrant” means the individual, company, organisation, government body or other eligible entity recorded as the holder of a Domain Name.

“Registrar” means Zenpipe Nexus Sdn. Bhd., being a Registrar appointed by MYNIC to provide .MY domain name registration and related services.

“Registry” means MYNIC Berhad, being the entity responsible for administering and operating the .MY domain namespace.

“Registration Information” means information provided in connection with an application, registration, renewal, transfer or administration of a Domain Name.

“MYNIC Policies” means all applicable policies, agreements, rules, procedures, standards and requirements published or imposed by MYNIC from time to time.

“Fees” means registration, renewal, transfer, restoration, premium, administrative or other applicable charges relating to a Domain Name.

“Registration Period” means the period for which the Domain Name is registered with the Registry.

 

3. ROLE OF MYNIC AND ZENPIPE

3.1 MYNIC as Registry

The Registrant acknowledges that MYNIC is the Registry responsible for the administration and operation of the .MY domain namespace.

MYNIC establishes policies, technical requirements, eligibility criteria, dispute resolution procedures and other requirements applicable to .MY Domain Names.

The ultimate registration and continued existence of a .MY Domain Name within the Registry is subject to applicable MYNIC Policies.

3.2 Zenpipe as Registrar

Zenpipe is a Registrar appointed by MYNIC to provide .MY Domain Name registration services to Registrants.

As Registrar, Zenpipe may:

  • Receive and process Domain Name applications;

  • Submit registration requests and Registrant information to MYNIC;

  • Process Domain Name renewals;

  • Facilitate Registrar transfers;

  • Maintain and update Registration Information;

  • Perform Registrant verification;

  • Collect applicable Fees;

  • Provide Domain Name management services;

  • Communicate Registry notices and requirements to Registrants;

  • Assist with compliance with MYNIC Policies;

  • Receive and process supporting documentation;

  • Handle Domain Name administrative requests; and

  • Perform other Registrar functions permitted or required by MYNIC.

Zenpipe does not own or control the .MY namespace and cannot override a decision, mandatory requirement or policy imposed by MYNIC or a competent Malaysian authority.

 

4. APPLICATION OF MYNIC POLICIES

Every .MY Domain Name registered through Zenpipe remains subject to applicable MYNIC Policies.

The Registrant agrees to comply with all applicable MYNIC policies, which may include, without limitation:

  • MYNIC Registrant Agreement;

  • Registrant Policy;

  • Registry Policy;

  • Acceptable Use & Abuse Policy;

  • Transfer Registrar Policy;

  • Data Protection Policy;

  • Data Processing Terms and Conditions;

  • .MY Domain Name Dispute Resolution Policy (“MYDRP”);

  • Rules of the MYDRP;

  • Triple I Policy and Process;

  • Regulated Names Policy and Process;

  • Numbering and Electronic Addressing Plan (“NEAP”); and

  • Any other policy, procedure, requirement or guideline issued by MYNIC from time to time.

The Registrant acknowledges that MYNIC may amend its policies and requirements from time to time.

Continued registration and use of a Domain Name is subject to compliance with the applicable MYNIC Policies then in force.

 

5. REGISTRANT ELIGIBILITY

The Registrant represents and warrants that:

  1. the Registrant satisfies the eligibility requirements applicable to the Domain Name;

  2. the Registrant will continue to satisfy applicable eligibility requirements throughout the Registration Period;

  3. all information and supporting documents submitted are genuine, accurate, complete and current;

  4. the Domain Name application is made in good faith;

  5. the Registrant has the legal capacity and authority to enter into this Agreement; and

  6. where an application is made by a representative, employee, agent or third party, that person has proper authority to act on behalf of the Registrant.

Zenpipe may request supporting documents or additional information where required by MYNIC, applicable policy, law or Zenpipe’s verification procedures.

 

6. REGISTRATION INFORMATION

The Registrant must provide accurate, complete and current Registration Information.

Depending on the applicable Domain Name category, Registration Information may include:

  • Full legal name;

  • National identification or other identification information where required;

  • Company or organisation name;

  • Company or organisation registration number;

  • Postal address;

  • Email address;

  • Telephone number;

  • Administrative contact details;

  • Technical contact details;

  • Billing contact details;

  • Eligibility information; and

  • Supporting documents required by MYNIC.

The Registrant must promptly notify Zenpipe of any changes and ensure that Registration Information remains accurate throughout the Registration Period.

Zenpipe may verify Registration Information and may request additional information or documents where reasonably required.

Failure to provide or maintain accurate information may result in an application being rejected or a Domain Name being suspended, restricted or deleted in accordance with applicable MYNIC Policies.

 

7. REGISTRATION OF A DOMAIN NAME

Submission of a Domain Name application and payment of applicable Fees does not guarantee registration.

A Domain Name shall only be considered successfully registered after the application has been accepted and successfully recorded by the MYNIC Registry.

Zenpipe does not guarantee that a Domain Name shown as available during a search will remain available until registration has been successfully completed by MYNIC.

An application may be rejected where:

  • The Domain Name is no longer available;

  • The Registrant does not satisfy eligibility requirements;

  • Registration Information cannot be verified;

  • Required documents have not been supplied;

  • The Domain Name is reserved, restricted or regulated;

  • Payment has not been completed;

  • Registration would breach a MYNIC Policy;

  • Registration would breach applicable law; or

  • MYNIC otherwise rejects the application in accordance with its applicable policies.

 

8. RIGHTS IN A DOMAIN NAME

Registration of a .MY Domain Name does not confer ownership of the Domain Name upon the Registrant.

Subject to MYNIC Policies, successful registration provides the Registrant with a right to use the Domain Name during the applicable Registration Period.

The Registrant acknowledges that registration of a Domain Name does not create or establish any trademark, trade name, intellectual property or other proprietary right.

The Registrant is responsible for determining whether registration or use of the Domain Name infringes the rights of any third party.

 

9. REGISTRANT REPRESENTATIONS AND WARRANTIES

The Registrant represents and warrants that:

  1. registration and use of the Domain Name will comply with applicable Malaysian laws;

  2. the Domain Name will not knowingly infringe the trademark, copyright, trade name, privacy, intellectual property or other rights of any third party;

  3. the Domain Name has not been registered for fraudulent, deceptive, abusive or unlawful purposes;

  4. the Domain Name will not knowingly be used for phishing, malware, fraud, impersonation, spam, unlawful content or other prohibited activities;

  5. all Registration Information supplied to Zenpipe and MYNIC is accurate and genuine;

  6. any supporting documents supplied are genuine and valid;

  7. the Registrant possesses all licences, permissions, approvals or authorisations required for activities associated with the Domain Name;

  8. the Domain Name will not be registered or used in bad faith; and

  9. the Registrant will comply with applicable MYNIC Policies throughout the Registration Period.

 

10. RESTRICTED, RESERVED AND REGULATED DOMAIN NAMES

Certain .MY Domain Names may be reserved, restricted, regulated, sensitive, premium or otherwise subject to additional registration requirements.

An application may require:

  • Supporting documentation;

  • Proof of identity;

  • Proof of business or organisation registration;

  • Proof of trademark or intellectual property rights;

  • Government or regulatory approval;

  • Letter of authorisation;

  • Statutory declaration or other declaration;

  • Proof of eligibility;

  • Additional Registrant declarations; or

  • Manual review by Zenpipe and/or MYNIC.

Zenpipe may withhold submission or completion of an application until all required information and documentation have been received and verified.

Submission of an application for a restricted or regulated Domain Name does not guarantee approval.

The final acceptance of the registration remains subject to MYNIC’s applicable policies and requirements.

 

11. FEES AND PAYMENT

The Registrant agrees to pay all Fees applicable to the Domain Name.

Fees may include:

  • Registration Fees;

  • Renewal Fees;

  • Transfer Fees;

  • Restoration or redemption Fees;

  • Premium Domain Name Fees;

  • Administrative Fees;

  • Applicable taxes; and

  • Other charges permitted under applicable MYNIC Policies.

Unless otherwise provided by applicable law, MYNIC Policy or Zenpipe’s refund policy, Fees relating to successfully completed Domain Name transactions are non-refundable.

Zenpipe may revise its Fees from time to time.

 

12. RENEWAL AND EXPIRATION

The Registrant is responsible for ensuring that a Domain Name is renewed before expiry.

Zenpipe may issue renewal notices as a service to the Registrant. However, failure to receive such a notice does not remove the Registrant’s responsibility to renew the Domain Name.

Where automatic renewal is enabled, renewal remains subject to:

  • Successful payment;

  • Continued eligibility;

  • Accurate Registration Information;

  • Applicable MYNIC requirements; and

  • Availability of the applicable renewal service.

If a Domain Name is not renewed, it may expire, become suspended or be deleted in accordance with MYNIC’s applicable lifecycle and renewal policies.

Recovery of an expired Domain Name cannot be guaranteed.

 

13. TRANSFER OF REGISTRAR

The Registrant may request the transfer of a Domain Name between MYNIC-appointed Registrars in accordance with applicable MYNIC transfer policies.

Zenpipe may perform identity, security or ownership verification before approving or processing a transfer.

A transfer may be delayed or rejected where permitted or required by:

  • MYNIC Policy;

  • Applicable law;

  • A court order;

  • Regulatory instruction;

  • A pending dispute;

  • Security concerns;

  • Incomplete verification;

  • Outstanding requirements; or

  • Other circumstances permitted by MYNIC.

Zenpipe shall cooperate with legitimate transfer requests in accordance with applicable MYNIC requirements.

 

14. DOMAIN NAME SUSPENSION, RESTRICTION OR DELETION

The Registrant acknowledges that a Domain Name may be suspended, restricted, cancelled, deleted or otherwise affected where permitted or required by MYNIC Policies or Malaysian law.

Circumstances may include:

  • False, misleading or inaccurate Registration Information;

  • Failure to verify Registrant information;

  • Failure to provide required documentation;

  • Failure to maintain eligibility;

  • Non-payment of applicable Fees;

  • Breach of this Agreement;

  • Breach of MYNIC Policies;

  • Fraudulent or unlawful activity;

  • Abuse of the Domain Name or DNS infrastructure;

  • Infringement of third-party rights;

  • A decision under an applicable dispute resolution procedure;

  • A court order;

  • A request or direction from a competent regulatory or law enforcement authority; or

  • Circumstances affecting the security, stability or integrity of the .MY namespace.

Where Zenpipe receives a mandatory instruction from MYNIC or a competent authority concerning a Domain Name, Zenpipe may take the action necessary to comply with that instruction.

 

15. ACCEPTABLE USE AND ABUSE

The Registrant must not use a Domain Name in violation of MYNIC’s applicable Acceptable Use & Abuse Policy or Malaysian law.

Prohibited activities may include, where applicable:

  • Phishing;

  • Malware distribution;

  • Botnet activities;

  • Fraud;

  • Impersonation;

  • Unlawful spam;

  • DNS abuse;

  • Distribution of unlawful content;

  • Activities intended to compromise systems or networks; and

  • Other activities prohibited under applicable MYNIC Policies.

Zenpipe may investigate abuse reports concerning Domain Names under its management.

Zenpipe may cooperate with MYNIC, law enforcement agencies, regulators, courts and other competent authorities where required or permitted by law.

 

16. DOMAIN NAME DISPUTES

The Registrant acknowledges and agrees that disputes concerning a .MY Domain Name may be subject to the .MY Domain Name Dispute Resolution Policy (“MYDRP”) and applicable Rules.

The Registrant agrees to participate in applicable dispute resolution proceedings and comply with decisions issued under those procedures.

Zenpipe acts as Registrar and does not determine competing trademark, intellectual property or ownership claims between parties.

Zenpipe may implement decisions or instructions issued by MYNIC, an authorised dispute resolution provider, a court or another competent authority.

 

17. PERSONAL DATA AND PRIVACY

In acting as Registrar, Zenpipe is required to collect and process certain Registration Information and personal data.

Zenpipe may process such information for purposes including:

  • Domain Name registration;

  • Renewal;

  • Transfer;

  • Registrant verification;

  • Domain administration;

  • Billing and payment;

  • Submission of required information to MYNIC;

  • Fraud prevention;

  • Security and abuse management;

  • Regulatory compliance;

  • Dispute resolution;

  • Customer support; and

  • Maintaining transaction, consent and audit records.

Where necessary for Domain Name registration and administration, Zenpipe may disclose Registration Information to MYNIC and other parties authorised or required to receive such information.

Zenpipe will process personal data in accordance with its applicable Personal Data Protection Notice, the Personal Data Protection Act 2010 (Act 709) and other applicable legal requirements.

Where the Registrant provides personal data concerning another individual, the Registrant represents that they have appropriate authority to provide that information.

 

18. REGISTRANT ACCOUNT SECURITY

The Registrant is responsible for protecting:

  • Zenpipe customer account credentials;

  • Passwords;

  • Multi-factor authentication credentials;

  • Authorised email accounts;

  • Domain management credentials; and

  • Other authentication information.

The Registrant must notify Zenpipe promptly upon discovering suspected unauthorised access, account compromise or unauthorised changes affecting a Domain Name.

Zenpipe may require additional identity verification before performing security-sensitive operations.

 

19. COMMUNICATIONS FROM THE REGISTRAR

The Registrant authorises Zenpipe to communicate regarding:

  • Registration status;

  • Verification requirements;

  • Renewal;

  • Expiration;

  • Transfer;

  • Security;

  • Abuse;

  • Billing;

  • MYNIC policy requirements;

  • Disputes; and

  • Other matters necessary for administration of the Domain Name.

Such communications may be delivered by email, customer portal notification or other reasonable electronic means.

The Registrant is responsible for maintaining valid and current contact details.

 

20. SERVICE AVAILABILITY

Zenpipe will use reasonable efforts to provide reliable Registrar services.

The Registrant acknowledges that .MY Domain Name services depend upon MYNIC’s Registry infrastructure, DNS infrastructure, telecommunications networks and other systems that may be outside Zenpipe’s direct control.

Zenpipe does not guarantee uninterrupted or error-free availability.

Services may be affected by:

  • Scheduled maintenance;

  • Emergency maintenance;

  • MYNIC Registry maintenance;

  • Network outages;

  • DNS incidents;

  • Cybersecurity events;

  • Government or regulatory actions; or

  • Events beyond Zenpipe’s reasonable control.

 

21. LIMITATION OF LIABILITY

To the maximum extent permitted under applicable law, Zenpipe shall not be liable for indirect, incidental, special, punitive or consequential losses arising from the registration, administration or use of a Domain Name.

This includes, where permitted by law, loss arising from:

  • Failure by the Registrant to renew;

  • Incorrect Registration Information;

  • Rejection of a registration by MYNIC;

  • Actions taken by MYNIC pursuant to its policies;

  • Decisions under a Domain Name dispute;

  • Suspension required by law or MYNIC Policy;

  • Unauthorised access caused by compromise of Registrant credentials;

  • DNS, Registry or third-party infrastructure failures; or

  • Events beyond Zenpipe’s reasonable control.

To the extent permitted by law, Zenpipe’s aggregate liability relating to a particular Domain Name service shall not exceed the Fees paid to Zenpipe for that affected Domain Name service during the relevant Registration Period.

Nothing in this Agreement excludes or limits liability that cannot lawfully be excluded or limited under Malaysian law.

 

22. INDEMNIFICATION

To the maximum extent permitted by applicable law, the Registrant agrees to indemnify and hold harmless Zenpipe, its directors, officers, employees, agents and contractors against claims, losses, liabilities, damages and reasonable costs arising from:

  • The Registrant’s registration or use of a Domain Name;

  • Breach of this Agreement;

  • Breach of applicable MYNIC Policies;

  • False or misleading Registration Information;

  • Infringement of third-party rights;

  • Unlawful activities associated with the Domain Name; or

  • Acts or omissions of persons authorised by the Registrant to manage the Domain Name.

 

23. MYNIC DIRECTIONS AND REGISTRY ACTIONS

The Registrant acknowledges that MYNIC, as the .MY Registry, may exercise powers and perform actions in accordance with applicable MYNIC Policies and Malaysian law.

Where MYNIC issues a valid direction to Zenpipe concerning a Domain Name under applicable policies, Zenpipe may implement that direction.

Zenpipe shall not be considered in breach of this Agreement merely because it performs an action required by MYNIC, a competent authority, applicable law, a court order or an authorised dispute resolution process.

 

24. CHANGES TO MYNIC POLICIES

MYNIC may introduce, amend, replace or withdraw policies and requirements applicable to .MY Domain Names.

The Registrant agrees that continued registration of a Domain Name remains subject to applicable MYNIC Policies as amended from time to time.

Zenpipe may update this Agreement where necessary to reflect changes introduced by MYNIC.

 

25. CHANGES TO THIS AGREEMENT

Zenpipe may amend this Agreement where reasonably necessary due to:

  • Changes to MYNIC Policies;

  • Changes in law or regulation;

  • Changes to Registrar requirements;

  • Security requirements;

  • Changes to Zenpipe’s services; or

  • Operational requirements.

The current version of this Agreement will be made available through Zenpipe’s website or customer portal.

Where reasonably appropriate, Zenpipe may notify affected Registrants of material changes.

 

26. TERMINATION

This Agreement applies for as long as the Registrant maintains a .MY Domain Name through Zenpipe.

The Agreement may cease to apply to a Domain Name following:

  • Transfer to another Registrar;

  • Expiration and deletion;

  • Cancellation;

  • Termination of the registration; or

  • Other circumstances under applicable MYNIC Policies.

Termination does not affect rights, obligations or liabilities accrued before termination.

Provisions concerning liability, indemnification, disputes, personal data, audit records and other matters intended by their nature to survive shall continue to apply where appropriate.

 

27. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of Malaysia.

Subject to applicable MYNIC dispute resolution procedures and any mandatory legal requirements, the parties submit to the jurisdiction of the courts of Malaysia.

 

28. SEVERABILITY

If any provision of this Agreement is found to be invalid, unlawful or unenforceable, that provision shall be interpreted or limited to the extent necessary, and the remaining provisions shall continue in full force and effect.

 

29. NO WAIVER

Failure by Zenpipe to enforce any provision of this Agreement does not constitute a waiver of that provision or any other right.

 

30. ORDER OF PRECEDENCE

The Registrant acknowledges that .MY Domain Name registration involves both Registry and Registrar requirements.

Where applicable, the following order of precedence shall apply:

  1. Applicable Malaysian laws, regulations, court orders and lawful directions of competent authorities;

  2. Mandatory MYNIC policies, rules and Registry requirements;

  3. This .MY Domain Name Registrant Agreement;

  4. Other applicable Zenpipe terms and policies.

Nothing in this Agreement authorises Zenpipe or the Registrant to disregard a mandatory requirement imposed by MYNIC.

REGISTRANT ACKNOWLEDGEMENT

By submitting an application to register, renew or transfer a .MY Domain Name through Zenpipe Nexus Sdn. Bhd., the Registrant confirms that:

1. I have read, understood and agree to this Zenpipe Nexus Sdn. Bhd. .MY Domain Name Registrant Agreement.

2. I understand that Zenpipe Nexus Sdn. Bhd. is a Registrar appointed by MYNIC to provide .MY Domain Name registration services.

3. I understand that MYNIC is the Registry responsible for administration of the .MY domain namespace.

4. I agree to comply with all applicable MYNIC policies, rules and procedures relating to my .MY Domain Name.

5. I confirm that all Registration Information and supporting documentation I have provided is accurate, complete, current and genuine.

6. I confirm that I am the Registrant or have proper authority to act on behalf of the Registrant.

7. I understand that registration gives the Registrant a right to use the Domain Name subject to applicable MYNIC policies and does not confer ownership of the Domain Name.

8. I acknowledge that Zenpipe may provide Registration Information and other required information to MYNIC for the purposes of registering and administering the Domain Name.

9. I acknowledge that I have read and understood Zenpipe’s applicable Personal Data Protection Notice.

10. I understand that the Domain Name may be suspended, restricted, transferred, cancelled or deleted where required or permitted under applicable MYNIC policies or Malaysian law.
